Terms of Use

These terms are an agreement between you and Black Bay ("we", "us") covering your use of the Black Bay app and its related services. By creating an account or using the app, you agree to them and to the Community Rules, which form part of these terms. If you do not agree, do not use Black Bay.

1. Eligibility and your account

• You must be at least 18 years old.
• One person, one account. You are responsible for everything done through your account and for keeping access to your email secure.
• Your username is permanent once chosen, because your trading record is attached to it.

2. Zero tolerance for objectionable content and abusive users

Black Bay does not tolerate objectionable content or abusive behaviour. You may not post, list or send anything that:

• breaks the Community Rules, including listing prohibited items;
• harasses, threatens, bullies or demeans anyone, or promotes hate;
• is sexually explicit or shows graphic violence;
• encourages illegal or reckless use of a knife or any other weapon;
• reveals someone's private information;
• is a scam, spam, fraud or impersonation; or
• infringes someone else's rights or breaks the law.

Posts, comments, listings and direct messages are screened automatically when they are written. Any member can report content or block another member from inside the app. Reports are reviewed by a person and we aim to act within 24 hours, by removing the content and, where warranted, removing the member who posted it.

3. Membership and billing

• Membership is an auto-renewing annual subscription, sold through Apple's App Store on iPhone and Google Play on Android. There are two tiers, Basic and Pro; the current price for your region is shown in the app before you buy.
• On iPhone, payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically each year unless you cancel it at least 24 hours before the current period ends, and your Apple ID is charged for the renewal within the 24 hours before the period ends.
• On Android, payment is charged to your Google Play account when you confirm the purchase. The subscription renews automatically each year unless you cancel it before the renewal date.
• You can manage or cancel your subscription at any time in your Apple ID account settings or in Google Play under Payments & subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Change plans on the platform you subscribed on.
• Apple and Google handle payments and refunds under their own policies. We cannot issue refunds for App Store or Google Play purchases.
• Deleting your Black Bay account does not cancel your subscription. Cancel it in your Apple ID settings or in Google Play.
• Dues are not refunded if your account is suspended or removed for breaking these terms.

4. Black Bay is a community, not a marketplace

Members can advertise items and arrange sales and trades with each other. We are not a party to those deals. We do not sell anything, process payments, hold funds, provide escrow, ship items, or take a commission, and we do not inspect or verify items or vouch for any member.

Trading records shown on profiles, such as completed sales and vouches, are based on what members report and confirm to each other. They are information, not a guarantee.

You are responsible for your own deals. Whether you are selling, buying or trading, you alone are responsible for making sure that every item you list, sell, buy or trade, and every shipment you send or receive, complies with the law that applies to you and to the other member: federal, state and local. That includes laws on automatic (switchblade), OTF and other restricted knives, such as the Federal Switchblade Act (15 U.S.C. §§ 1241–1245), which restricts shipping switchblade knives across state lines.

We do not check whether a listing or deal is legal. Our screening and moderation catch some prohibited items, but they are not a legal review, and a listing appearing on Black Bay does not mean the item is legal for you to sell, buy, own or ship. Any dispute about a deal is between you and the other member.

5. Your content

You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display your content for the purpose of operating Black Bay and showing it to the members you share it with. This licence ends when you delete the content or your account, except for copies in routine backups until they are overwritten. You must have the right to post everything you post.

6. Moderation and ending your account

We may remove content, restrict features, suspend accounts or permanently remove members who break these terms or put other members at risk. A banned member loses access immediately, even with an active subscription.

You can delete your account at any time in Settings → Account → Delete account. Deletion is permanent.

7. Disclaimers

Black Bay is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including that the service will be uninterrupted or error-free, or about any member, item, listing or deal.

8. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any loss arising from a deal, dispute or communication between members. Our total liability to you for any claim relating to Black Bay is limited to the dues you paid for Black Bay in the twelve months before the claim arose.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for Black Bay or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any); Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes a third party's intellectual property; we are responsible for handling those to the extent these terms do not disclaim them. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes

We may update these terms. If a change is significant we will tell you by email or in the app before it takes effect. Continuing to use Black Bay after that means you accept the updated terms.
